Litigation

Where the advancement or protection of a client’s interests necessitates participation in or commencement of litigation, the TechComm group, in cooperation with our Litigation Department, has all the necessary skills and experience to effectively and efficiently represent our clients.

We represent clients in contested administrative hearings before the FCC and state regulatory agencies on rulemaking, ratemaking, licensing, and enforcement issues. Our experience further extends to representing clients in federal and state appellate judicial review of FCC and state agency decisions, including review of FCC decisions and rules before the United States Courts of Appeals. In addition, we advise and represent clients involved in civil and criminal federal investigations and litigation related to the E-rate Program and the Universal Service Fund, including qui tam and False Claims Act cases.

We also represent clients in commercial litigation relating to a variety of issues, including disputes over contracts, intellectual property rights, employment law, and bankruptcy matters. We have appeared in federal and state courts and participated in international arbitral tribunals. We work with clients on government investigations of their business practices. Our broad-based litigation practice allows the TechComm group to bring to bear all the skills necessary to address the array of litigation situations that a technology or communications client might face, including law enforcement related matters.
